Fonte's failure to enforce any part of these GTC does not constitute a waiver. If any provision is found invalid by a competent court, the remaining provisions remain effective.

Fonte may assign or transfer its rights or obligations under these GTC at any time without your consent. You may not assign or transfer your rights without written approval.

You agree not to use the services unlawfully, not to infringe intellectual property rights, or interfere with the system, data, or users.

1.3 Changes to the GTC

Fonte reserves the right to modify these GTC at any time. Your continued use of the services after such changes indicates your acceptance. It is your responsibility to check www.fontedrinks.com/terms regularly for updates.

2. USE OF ONLINE SERVICES

2.1 Customer Account

To access full services, you must create a customer account.

You confirm you are at least 18 years old, legally capable, and authorized to use the services. If you are representing a company, you confirm you have the authority to do so.

You are responsible for your login credentials and all activity through your account. Notify us immediately of any suspicious activity. Fonte is not liable for losses due to account misuse.

Provide accurate and up-to-date information. Fonte reserves the right to suspend or terminate accounts with false or incomplete information or for any violation of the GTC.

2.2 Modification or Termination of Services

Fonte may modify or discontinue services at any time without notice or liability.

2.3 Intellectual Property

All content on the website is protected by intellectual property law. Reproduction or external use requires prior written authorization from Fonte.

2.4 Data Protection

Please refer to our Privacy Policy for information on how we use your personal data.

2.5 Cyber Security

Content downloaded through the services is at your own risk. Fonte is not liable for damage to your system or data loss resulting from downloads.

3. TERMS OF SALE

3.1 Ordering Requirements

To place an order, you must have a valid customer account.

3.2 Prices

All prices are displayed in the relevant currency (CHF or EUR) and include VAT where applicable. Delivery charges are shown separately and vary based on weight, location, and other factors.

Prices may change without notice. Confirmed orders are honored at the price at the time of confirmation.

3.3 Order Confirmation & Payment

Orders constitute an offer to purchase under these GTC. Orders are only final once payment has been received in full via the payment methods offered (e.g., Stripe, credit card, etc.).

Fonte is not responsible for payment processing services' functionality.

You must verify your delivery and billing information. Fonte will confirm your order via email.

3.4 Delivery

We deliver throughout Switzerland and the EU. Delivery times are 5–7 working days. During peak periods, delays may occur.

Fonte is not liable for issues beyond its control (e.g., wrong address, customs delays, weather). Customs duties outside Switzerland are the customer’s responsibility.

3.5 Returns

Returns are only accepted for incorrect deliveries. Notify us within 5 working days at info@fontedrinks.com with order details.

We will arrange for return and re-delivery or refund if applicable. Refunds are processed within approx. 7 working days after validation.

3.6 Alcohol Sales

We do not sell alcoholic products to individuals under 18 years of age. By ordering, you confirm compliance.

3.7 Discount Vouchers

Discount codes may be offered and are subject to conditions. They cannot be combined, applied retroactively, or converted to cash.

4. LIABILITY & LEGAL

4.1 Disclaimer

Use of services is at your own risk. Services are provided "as is" without warranties. Fonte does not guarantee uninterrupted service, accuracy, or suitability for your purpose.

4.2 Indemnity

You agree to indemnify Fonte against any claims or damages resulting from misuse of the services or violation of these GTC.

4.3 Limitation of Liability

Fonte is not liable for indirect, incidental, or consequential damages, including loss of data, profits, or service availability.

4.4 Legal Jurisdiction

These GTC are governed by Swiss law. Place of jurisdiction is the registered office of Fonte Drinks AG. Disputes shall be resolved amicably where possible.
